Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and PMM App Development LLC (“PMM,” “we,” “us,” or “our”). They govern your access to and use of our website at pmmappdev.com, our mobile and web applications (including BlurtBox / “Blurt and Sound Off” and any future apps we release), and the content channels we operate on third-party platforms such as YouTube and TikTok (collectively, the “Services”). Please read them carefully.

01Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services. Some apps may also have their own end-user license agreement or supplemental terms, which apply in addition to these Terms; if there is a conflict, the app-specific terms control for that app.

02Eligibility & Age

You must be at least 13 years old to use the Services, and you must meet any higher minimum age stated in an app’s store listing or its end-user license agreement. By using the Services, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.

03Our Services

PMM is an independent app studio. The Services include our marketing website, the applications we develop and distribute, and the videos and content we publish on our channels. We may add, change, suspend, or discontinue any part of the Services at any time. We are not obligated to maintain or support older versions of an app.

04Accounts

Some features require an account. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.

05Acceptable Use

You agree not to use the Services to:

• Violate any law or the rights of others;
• Post or transmit content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or that exploits or endangers minors;
• Impersonate any person or entity or misrepresent your affiliation;
• Upload viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Services or related systems;
• Interfere with or disrupt the Services, or circumvent any security, moderation, or rate-limiting measures;
• Scrape, harvest, or collect information about other users without authorization;
• Use the Services to send spam or unsolicited communications.

We may remove content and restrict or terminate access for conduct we determine, in our reasonable discretion, violates these Terms or harms the Services or others. Apps that allow anonymous participation are not an exception to these rules.

06User Content

You retain ownership of content you submit through the Services (“User Content”). By submitting User Content, you grant PMM a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that User Content as necessary to operate, provide, and promote the Services. You represent that you have the rights to grant this license and that your User Content does not violate these Terms or any law. You are solely responsible for your User Content, and we are not responsible for content submitted by users.

07Purchases & Subscriptions

Certain Services or features may be offered for purchase, including one-time purchases and auto-renewing subscriptions. Purchases made through the Apple App Store or Google Play are processed by those platforms and are subject to their terms. Unless otherwise stated:

• Subscriptions automatically renew at the then-current price until canceled;
• You can manage or cancel a subscription through your app store account settings;
• Refunds, where available, are handled according to the policies of the applicable app store;
• Prices and features may change; we will provide notice where required.

08Intellectual Property

The Services, including our software, designs, text, graphics, logos, and the content we publish on our channels, are owned by PMM or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Services except as permitted by law or with our written consent.

09App Stores & Third Parties

If you download an app from the Apple App Store, you acknowledge that these Terms are between you and PMM only, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Similar terms apply to Google Play and other distribution platforms. Your use of any third-party service accessed through the Services is governed by that third party’s terms.

10Our Content Channels

The videos and content we publish on platforms such as YouTube and TikTok are provided for general information and entertainment. They do not constitute professional, financial, or legal advice. Your use of those platforms is also governed by the platforms’ own terms and policies, which we do not control.

11Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any content is accurate or reliable.

12Limitation of Liability

To the fullest extent permitted by law, PMM and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the relevant Service in the twelve months before the claim, or fifty U.S. dollars (US$50).

13Indemnification

You agree to indemnify and hold harmless PMM and its members, officers, and contractors from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms or the rights of any third party.

14Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue a Service. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

15Governing Law & Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in your local courts.

16Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
